Un fiscal de Argentina inició una investigación sobre posibles crímenes de lesa humanidad en Venezuela tras una denuncia penal presentada por la Fundación Clooney para la Justicia.

El fiscal federal Carlos Stornelli señaló que la denuncia apuntaba a la responsabilidad de varios miembros de alto rango de la Guardia Nacional venezolana en abusos contra los derechos humanos durante las protestas callejeras de 2014 contra el gobierno del presidente Nicolás Maduro.

La decisión de la fundación creada por el actor George Clooney y su esposa, la abogada de derechos humanos Amal Clooney, marca el último esfuerzo para utilizar el sistema legal de Argentina y el principio de jurisdicción universal para enjuiciar crímenes de lesa humanidad cometidos en otros lugares.

La fundación eligió Argentina para presentar su denuncia porque el sistema de justicia del país ya ha aplicado el principio de jurisdicción universal para investigar presuntos crímenes de lesa humanidad cometidos en España y Myanmar.

La Fundación Clooney para la Justicia representa a las familias de dos venezolanos asesinados durante las protestas de 2014 en las que murieron decenas de personas.

“Estos dos casos ilustran una preocupación mucho más amplia que la fundación tiene sobre graves violaciones sistemáticas de derechos humanos donde hay una cadena de mando”, dijo Ignacio Jovtis, gerente senior del programa de la Fundación Clooney para la Justicia, en el momento en que se presentó la queja.

La Fundación alega que las similitudes en la forma en que las dos víctimas fueron asesinadas demuestran que la violencia contra las protestas fue parte de “un plan sistemático” que incluía “la ausencia absoluta de procedimientos” en el liderazgo de la Guardia Nacional venezolana para “investigar los hechos y castigar a los responsables”, escribió Stornelli en su escrito, una copia del cual fue obtenida por The Associated Press.

En su escrito, Stornelli solicitó una serie de medidas que deben ser aprobadas previamente por un juez federal. Estas medidas incluyen emitir solicitudes a la justicia venezolana para que envíe copias de los procedimientos judiciales y a los hospitales donde fueron atendidas las víctimas para acceder a los registros médicos, una lista de profesionales que las trataron y certificados de defunción.

También pidió que se solicitaran documentos a las Naciones Unidas, la Organización de los Estados Americanos, la Comisión Interamericana de Derechos Humanos y la Corte Penal Internacional.

Una misión de investigación de las Naciones Unidas a Venezuela concluyó que en 2022 se llevaron a cabo crímenes de lesa humanidad en Venezuela. La cuestión también está siendo investigada por la Corte Penal Internacional de La Haya.
